Logistics Service Agreement

Welcome to use the services of Chaofan Express (Shenzhen) Co., Ltd.

This Agreement is entered into .you (or "User") and Chaofan Express (Shenzhen) Co., Ltd. (or "We") for cross-border logistics services.

Before using the logistics service, please read carefully and fully understand this agreement (if you are under the age of 16,.if you are over the age of 16 but under the age of 18 and cannot use your own labor income as the main source of income, please contact your legal guardian accompany you to read this agreement), especially the disclaimer clauses, privacy protection policies, standard indemnity clauses , dispute resolution clauses (including jurisdiction clauses), and other indications in the form of bold, black and/or underlined important terms that you pay attention to, please be sure to check them out.

1. You acknowledge that you may need to provide some necessary information when using the services we provide. You must ensure that the information you fill in and provide is true, accurate and complete, otherwise you may not be able to use the service,.you may be restricted during use, and even affect whether you can use the specific functions we provide. You are responsible for any liability and loss caused by untrue, inaccurate,.incomplete information provided by you. We have the right to decide whether to provide you with a service based on the authenticity, accuracy, completeness of the information you provide and whether it meets other conditions specified in the service. In the process of using the services provided by us, if the information provided by you changes, you should make changes in time.

 

2. you confirm that you can purchase goods through Taobao, JD, 1688 and other shopping platforms, you can place an order in our system and fill in the logistics information, and we will provide you with cross-border logistics services. We will provide you with cross-border logistics related services such as online ordering, intelligent status push, timeliness inquiry, and logistics distribution.

 

3. You confirm that the goods is deemed to have been delivered and we have completed the obligations in accordance with the " Logistics Service Agreement”, when we have delivered the goods to the recipient address you provided, and the designated recipient signs for receipt,.the designated recipient picks up the goods with the corresponding credentials.

 

4. If there is any dispute over the content of the service agreement.its performance, both parties shall try their best to resolve it through friendly negotiation. .nbsp;the negotiation fails, either party shall file a lawsuit to the Court of Nanshan District, Shenzhen, .the agreement is signed.

 

5. Personal Information Protection and Privacy Policy

5.1 It is our consistent attitude to respect user privacy and protect the security of your personal information, and we will take reasonable measures to protect your personal information and privacy. We promise that, unless we obtain the user's consent, we will not collect.use the user's personal information other than those necessary to provide services.use the information for purposes other than providing services.

5.2 Security protection: We will use various security technologies and procedures to establish a sound management system to protect your personal information and privacy from unauthorized access, use.disclosure.

5.3 Information use and disclosure: We have the right to obtain, use, store and share your personal information in an explicit manner on the premise of complying with laws and regulations. We will not disclose, edit,.disclose your personal information and the non-public content you keep with us without your authorization. You agree and warrant: We have the right to collect and use your relevant information in accordance with the personal information protection rules we have formulated.

5.4 You agree that we have the right to collect your usage and behavior information through technologies such as cookies, and to freely use the desensitized pure commercial data when it is desensitized so that it no longer points to.is associated with your personal identity information. Of course, you can also .cookies according to your preferences, but if you do, you will need to change your user settings yourself each time visit our website.

 

6. Compensation standard

6.1 You confirm that if the goods are lost during transportation due to our reasons, compensation shall be made according to the relevant standards of international air.freight, and the maximum amount of a single order shall not exceed RMB 600.

6.2 You confirm that we are not obligated to compensate if all shipping costs have not been paid for the goods.

6.3 We adopt the method of "claim review" for the value of the goods. When you apply for a claim, you should provide detailed reasons for the claim (including but not limited to the proof of the value of similar goods, the calculation method of loss, the appraisal report issued by the appraisal agency, etc.).

6.4 We especially remind you that we are not liable for compensation in the following circumstances,

1)the items you send are confiscated.dealt with by government because violating the laws and regulations for prohibition.restriction;

2)the items you send are requisitioned by the government;

3)deterioration, reduction, destruction.destruction caused by the nature of the goods themselves;

4)customs actions resulting from the declaration of goods;

5)due to the fault of you.the recipient, customs detention, weather.force majeure;

6)outer package is in good condition, but the inner parts are short.damaged , and the consignee or recipient does not raise any objection when picking up the goods.

6.5 Claims declaration time and feedback channels:

The claims for lost should be reported through relevant channels (including but not limited to the official website, customer service, etc.) within 48 hours after the goods are deemed to be delivered.

6.6 Coping methods in special scenarios:

1)You confirm thatwe can choose how to deal with the goods if you have not clearly indicated that you want return.abandon the goods within three days after we notify you that the customs clearance cannot be completed,.taxes and fines need to be paid .nbsp;other circumstances. If you do not pick up the goods after returned, it is deemed that you have given up ownership, and we can destroy.sell them by ourselves.

2)If goods cannot be continued to be shipped due to force majeure.government control actions, decisions.orders (including but not limited to the epidemic situation ) , we have the right to return the goods based on the actual situation after communicate with you to avoid expanding losses.

 

7. In order to ensure the safe delivery of the goods, you should fulfill the following obligations when sending the goods:

7.1 Responsible for providing accurate consignee information, including delivery location, telephone number, consignee and contact person and other relevant information. You are responsible for the recipient information of your goods.

7.2 The inside and outside of the goods are well packaged in advance, and a seal with a clear mark can be added if conditions permit.

7.3 Responsible for the legality of the goods. The goods are .including but not limited to) illegal, infringing, counterfeit, anti-dumping, arms, drugs, pornography, etc.

7.4 Responsible for the authenticity of the properties of the goods. The goods do not contain any dangerous and sensitive items such as gases, chemicals, fuels, inflammables, and explosives.

7.5 Responsible for the authenticity and accuracy of the declaration materials. The information of the goods should be truthfully provided, including but not limited to the product name, number, quantity, weight, volume, material, purpose, brand, shipping mark, declared price, whether it has relevant certification.authorization, etc. Ensure that the documents are consistent themselves, and the documents are consistent with the goods.

 

8. Payment and Return

8.1 After you place an order in the system, you should pay the logistics and transportation costs in time. You can pay by account recharge, corporate transfer, Alipay.WeChat payment. We will provide preferential policies such as coupons and points deduction according to your consumption situation. For details, please refer to the standards published on the official website.

8.2 If you intend to file a return application, you will be responsible for the cost of both trips. .nbsp;you give up the goods, you agree that we have the right to dispose the goods by ourselves and cannot claim any rights against us for the goods. You agree that the discounted amount of the used coupons.points will be deducted and will not be refunded after the return.

 

9. Your liability for breach of contract

9.1 You shall be liable for compensation if other goods, means of transport, machinery and equipment are polluted , corroded , damaged.cause personal injury.death due to potential safety hazards , quality defects.damaged packaging of your goods ;

9.2 You shall be liable for compensation us.a third party for delay in the timeliness.loss of value of other goods due to your goods are confiscated.detained for belonging to.containing prohibited.restricted delivery items.

 

10. Modifications and Updates

10.1 We have the right to .this agreement (including formulating and publishing other policies, rules, announcements and statements in a timely manner) when necessary in accordance with laws and regulation. The updated terms of the agreement will replace the original agreement and officially take effect after the expiration of the period stipulated by law. You can check the latest version of the terms of the agreement on the relevant service page. After this agreement is revised, if you continue to use the service, it is deemed that you have accepted the revised agreement. If you do not accept the revised agreement, you have the right to stop using the service.

 

11. If a clause is found to be invalid.partially invalid by a court.government agency, both parties agree to implement other clauses of this agreement except for the invalid clause, and valid clauses will continue to be enforced to the extent that they are enforceable .
